Welcome to MiniMoo AI! These Terms and Conditions govern your use of our mobile application and services. By downloading, installing, or using MiniMoo AI, you agree to be bound by these terms.

1. Acceptance of Terms

By accessing or using MiniMoo AI, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you may not use our service.

This agreement is between you and MiniMoo AI only, and not with Apple Inc. or Google LLC.

2. Eligibility

You must be at least 18 years old to use MiniMoo AI. The app is intended for parents, guardians, and adults creating content of children they are responsible for. By using the app you confirm that you are 18 or older and legally able to enter into this agreement.

3. Description of Service

MiniMoo AI is an artificial intelligence-powered mobile application that allows users to:

• Browse pre-built templates organised by category
• Upload a photo from the photo library or capture one with the camera
• Generate AI-created images based on the selected template and prompt
• Apply pre-built motion templates to an uploaded photo to generate AI videos
• Save, download, and share generated images and videos from the in-app gallery

Features vary by platform and may change over time.

4. User Responsibilities

When using MiniMoo AI, you agree to:

• Use the service only for lawful purposes
• Upload only media that you own or are authorised to use
• Confirm that you are the parent or legal guardian of, or otherwise authorised to provide media of, any child shown in your uploads
• Obtain consent where required from any recognizable adult shown in uploaded media
• Not attempt to reverse engineer, scrape, or overload the service or its APIs
• Be responsible for all activity carried out through your account

5. Content Guidelines

You agree not to upload, generate, or share content that:

• Is illegal, harmful, or offensive
• Infringes on intellectual property rights
• Contains personal information of others without consent
• Is sexually explicit or inappropriate, or sexualises a minor in any way
• Promotes violence, discrimination, or hate speech
• Contains malware, viruses, or harmful code
• Impersonates, misleads, harasses, or defames another person
• Uses someone else's likeness, image, or video without permission

We may remove content and suspend or terminate accounts that violate these guidelines.

6. Intellectual Property Rights

Your Content: You retain ownership of the images and videos you upload. You grant us a limited, non-exclusive licence to process that media solely to generate the output you request and to operate the service. This licence ends when the media is deleted.

Generated Content: Subject to your compliance with these Terms, you may use the images and videos you generate for personal and commercial purposes. AI-generated content may not be eligible for copyright protection in some jurisdictions.

Our Content: The MiniMoo AI app, including its design, code, brand, and template library, is protected by intellectual property laws and remains our property.

7. Privacy, Face Data, and Data Protection

Your privacy is important to us. Our collection, use, storage, sharing, and deletion of your personal information, including photos containing faces, is governed by our Privacy Policy, which is incorporated into these Terms by reference.

MiniMoo AI does not perform facial recognition or biometric identification, and does not create or store faceprints or biometric templates. See the Face Data section of our Privacy Policy for full details.

8. Coins, Purchases, and Refunds

MiniMoo AI operates on a coin system:

• Coins are a consumable virtual item used to pay for AI generations within the app
• Coins may be obtained through in-app purchase, promotional offers, daily streak rewards, or, on Android, by watching rewarded advertisements
• Coin packs are one-time purchases. MiniMoo AI does not currently offer auto-renewing subscriptions
• The number of coins required for a generation depends on the output type, length, and quality, and is shown in the app before you confirm
• If a generation fails for technical reasons, the coins spent are automatically refunded to your balance
• Coins have no monetary value, cannot be exchanged for cash, and cannot be transferred between accounts or platforms
• Coin pack pricing and coin quantities may change. Changes apply to future purchases only

All purchases are processed by Apple or Google. Refund requests are handled by Apple or Google under their own policies, not by us. Purchases are otherwise non-refundable except where required by law. Unused coins are forfeited if your account is deleted or terminated for breach of these Terms.

9. Advertising

On Android, MiniMoo AI may show optional rewarded advertisements that you can choose to watch in exchange for coins. Advertisements are never served using your uploaded photos or any face data.

10. Service Availability

We strive to provide reliable service but cannot guarantee:

• Uninterrupted or error-free operation
• Immediate availability of all features
• Compatibility with all devices or operating systems
• Specific quality, consistency, resemblance, or accuracy of generated images or videos

AI generation depends on third-party providers. Features may be modified, suspended, or discontinued where those providers change or withdraw their services.

11. Reference Media and Generated Videos

If you use reference image or reference video features, you are solely responsible for ensuring that you have all rights, permissions, and consents needed to upload that media and generate new output from it. You must not use MiniMoo AI to create deceptive, fraudulent, or harmful synthetic media, or to depict any real person without their permission.

12. Limitation of Liability

To the maximum extent permitted by law, MiniMoo AI shall not be liable for:

• Indirect, incidental, or consequential damages
• Loss of data, profits, or business opportunities
• Damages resulting from use of generated images or videos
• Third-party actions or content

Our total liability to you for any claim is limited to the amount you paid us in the twelve months before the claim arose.

13. Disclaimers

MiniMoo AI is provided "as is" without warranties of any kind. We disclaim all warranties, including:

• Warranties of merchantability or fitness for a particular purpose
• Warranties that the service will meet your specific requirements
• Warranties regarding the accuracy, likeness, or quality of AI-generated content

14. Account Deletion and Termination

You may delete your account and all associated data at any time from within the app, or by emailing [email protected].

We may terminate or suspend your access to MiniMoo AI:

• For violation of these Terms
• For fraudulent or illegal activity
• At our discretion with reasonable cause
• Upon your request to delete your account

15. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of significant changes through:

• In-app notifications
• Email communications
• Updates to this page

Continued use of the service after changes constitutes acceptance of the new terms.

16. Apple App Store Terms

The following applies where you obtained MiniMoo AI from the Apple App Store:

• These Terms are between you and MiniMoo AI only, not with Apple. Apple is not responsible for the app or its content
• Apple has no obligation to provide any maintenance or support for the app
• If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app
• MiniMoo AI, not Apple, is responsible for addressing any claims relating to the app, including product liability, legal or regulatory non-compliance, and consumer protection claims
• MiniMoo AI, not Apple, is responsible for investigating and resolving any third-party claim that the app infringes intellectual property rights
• You confirm that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you

17. Governing Law

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts of Gujarat, India, without prejudice to any mandatory consumer protection rights available to you in your country of residence.
